Deadline Extended to March 7 to Complete Part Two of the ILTA 2025 Safety Survey and the Platinum Safety Award Application

Part Two of the ILTA 2025 Safety Survey is an Excel-based survey that is based on U.S. OSHA Forms 300 and 300A. To apply for the Platinum Safety Award, companies must:

  • Complete the Platinum Safety Award Application.
  • Submit a proposal for the 2025 ILTA Terminal Operating Practices Symposium (TOPS).
  • Complete both Part One and Part Two of the ILTA 2025 Safety Survey.

ILTA Granted Waiver by EPA on NSPS Subpart XXa Petition for Reconsideration

On March 4, 2025, EPA sent a letter to ILTA, API, and AFPM granting part of the associations’ collective petitions on the 2024 gasoline distribution rule, specifically on the NSPS Subpart XXa provision. The full text of the letter can be found here.

 

ILTA will continue to meet with EPA regarding the rest of the gasoline distribution petition, as well as the separate NSPS Subpart Kc petition for reconsideration over the next few months.

ILTA Holds Hill Day as Part of Spring 2025 Board Meeting

On February 26, ILTA’s Board of Directors participated in the association’s annual congressional Hill Day as part of the Board’s spring meeting in Washington, DC.

 

The ILTA Board met with four Senate and five House offices during the event: Senator James Lankford (R-OK), Senator Angus King (I-ME), Senator Bernie Moreno (R-OH), Senator Cynthia Lummis (R-WY), Representative Bob Latta (R-OH-5), Representative Brian Babin (R-TX-36), Representative Buddy Carter (R-GA-1), Representative August Pfluger (R-TX-11), and Representative Bennie Thompson (D-MS-2).

 

ILTA staff and Board members also traveled to DHS CISA’s Arlington, VA office to meet with Associate Director Kelly Murray, whose office oversees security programs like CFATS, ChemLock, and beyond.

 

The Hill Day’s objective was to emphasize the importance of both the reauthorization of the CFATS program, as well as the need for liability protection for the terminals industry from Superfund designations related to PFAS remediation under CERCLA. ILTA will use these meetings as springboards for further advocacy work throughout the 119th Congress.

Court Stays Designation of PFOA and PFOS under CERCLA

In a February 24 order, the D.C. Circuit granted the Trump EPA’s request to stay, for sixty days, the industry’s challenge to the designation of PFOA and PFOS under the Superfund law (CERCLA). Initially, designated under the Biden EPA, the Trump administration sought the order, arguing that the EPA’s new leadership needed time to evaluate the existing rule. In this case, industry groups have been challenging the rule on the basis that the agency incorrectly demonstrated the danger of the chemicals and mishandled the cost analysis conducted for the rule. Consequently, the request allows the new administration to review and potentially revise or rescind the regulation. This announcement comes just weeks after the Biden EPA announced a brief defending the rule in its final days in office.

 

It remains unclear whether the Trump administration will choose to revise, scrap, or keep the regulation as is. However, the Trump EPA has already withdrawn a Biden EPA draft proposal setting PFAS effluent limits for the chemical manufacturing sector and was also granted a stay of litigation challenging the Biden EPA’s PFAS drinking water rule. Regardless, ILTA will continue efforts to communicate the key considerations for liquid terminal owners’ liability under CERCLA in the new Congress and administration, advocating on the designation’s impact for its members.

Study Highlights Costs and Challenges of PFAS Cleanup for DOD

A report prepared by the Government Accountability Office (GAO) highlights the long-term and costly nature of PFAS remediation for the Department of Defense (DOD). The study highlights that the DOD estimates future PFAS investigation and cleanup costs to exceed $9 billion, a figure that has more than tripled since 2022. GAO found that these costs will continue to rise as DOD gains a better understanding of the scope of its PFAS releases through remedial investigations and determining the required cleanup actions. Additionally, while the study notes that DOD has completed the preliminary assessments and site inspections of nearly all its 718 installations, DOD has not begun any of the long-term cleanup at any of these sites. Consequently, Congress has required DOD to provide more details and examples of factors affecting costs to investigate and clean up PFAS. DOD’s challenges to transition away from AFFF underscore many of the similar logistical challenges faced by ILTA members.

Uncertainty on the Future of the Clean Fuels Production Credit

The future investments and development of the renewable fuels sector face some uncertainty. Earlier this year, the Department of the Treasury (Treasury) released guidance on the Clean Fuels Production Credit (Sec. 45Z), a tax credit that consolidates and replaces previous credits for biodiesel, renewable diesel, alternative fuels, and sustainable aviation fuel. The recently issued guidance marks an important step toward implementing the credit and supporting the future development of renewable fuels markets. However, since the notice serves as a precursor to proposed regulations, the credit remains subject to regulatory uncertainty, which may be compounded by the policies of the new administration.
