Alaska Passes AFFF Ban After Governor Veto
On July 22, Alaska lawmakers enacted a ban on AFFF after revising a previous version of the legislation was vetoed. The legislation, Senate Bill 67, passed both chambers with ease and did not see any action from Governor Mike Dunleavy. The law includes a firefighting substances disposal reimbursement program for small, rural communities to safely dispose of PFAS-based firefighting substances, rather than relying on the state to collect unused AFFF. When vetoing last year’s version of the legislation, Governor Dunleavy expressed concerns that the bill did not provide alternatives to AFFF for firefighting. While the new law still does not suggest or require any immediate alternatives to AFFF, it does shift the responsibility of its collection from the state to local governments.
Under the new law, Alaska bans the use of PFAS-based firefighting foam starting January 1, 2025, with exceptions for uses required by federal law or for businesses engaged in oil or gas production, transmission, transportation, or refining. However, the law also states that the oil and gas exemption will no longer apply if the state fire marshal adopts regulations determining that an alternative substance recognized by OSHA's Nationally Recognized Testing Laboratory Program (NRTLP) is safe and effective.
Property Sellers Face Growing Concerns of PFAS Liability
As EPA continues to take steps to address PFAS at contaminated sites, industry lawyers are advising property sellers to voluntarily assess whether PFAS are present at their sites. Following EPA’s actions to designate PFAS as hazardous substances under CERCLA and update its due diligence rule that gives prospective buyers of contaminated property an incentive to assess for PFAS, lawyers are cautioning property owners to conduct such assessments to limit potential PFAS uncertainties and improve their leverage in real estate transactions. Additionally, industry representatives are advising property sellers to hire their own environmental consultants to conduct PFAS assessments to prevent their purchaser’s consultants from overestimating potential PFAS contamination. Potential contamination discoveries on a property site could threaten real estate transactions, and contamination information could be utilized as a tool to leverage price negotiations.
Understanding the evolving regulatory landscape for PFAS is becoming increasingly important for property owners and other parties. Industry representatives continually emphasize the importance of being able to successfully navigate the increasing complexity of transactions involving PFAS, especially when considering the costs associated with contamination cleanup. ILTA continues to monitor key policies, advocate and analyze regulatory impacts, and communicate key considerations for its members.

Drone Usage Becoming More Incorporated into Terminal Facilities
Over the last decade, there has been a rise in drone usage at bulk liquid terminal facilities throughout the U.S. and the world. Of course, with new technology comes both advantages and disadvantages as terminals continue to grapple with the changing physical security landscape at their facilities.
Bulk liquid terminals, which are the primary midstream storage node for bulk goods like petroleum products, chemicals, asphalt, agricultural products like molasses and beyond, house critical resources as they make their way through the supply chain from producer to end user. As such, they are a potential target for bad actors and must constantly be monitored for any deviation from their normal operation.
